LP GAS INSTALLATIONS -
HOW THE AMENDED REGULATIONS WILL AFFECT YOU!

On the 15 July 2009, the Minister of Labour published an amendment to the Occupational Health and Safety Act of 1993, in respect of the "Pressure Equipment Regulations" No. 32395.

With effect from the 1st October 2009, in terms of the OHS Act (PER), only Registered (Authorised Persons) LP Gas Practitioners may install and maintain LP Gas appliances. This includes uninstalling / decommissioning.

This will place an onus on you as a property owner to ensure that:

1. You are aware that a new LP Gas compliance certificate will have to be issued as required by law when ownership changes.

2. You have a compliance certificate as required by law.

3. You do not have a non- compliant installation that could cost you thousands of rands in damage, apart from the possibility of severe fines for non-compliance.

4. Your Home structure and House contents insurance may be repudiated for fire related claims in cases where a valid Compliance certificate does not exist, whether the fire was caused by an LP Gas installation or not.

5. You understand that THERE IS NO EXPIRY DATE ON THE COMPLIANCE CERTIFICATE. A NEW ONE MUST BE ISSUED IRRESPECTIVE OF HOW NEW OR OLD THE CERTIFICATE IS, WHEN:

  5.1. A new Liquid Petroleum Gas appliance is installed.

  5.2. An existing Liquid Petroleum Gas installation is modified or altered.

  5.3. There is a change of User of the Liquid Petroleum Gas installation.

  5.4. There is a change of ownership of the property where a Liquid Petroleum Gas installation exists.

  5.5. Where a property is rented out, the Tenant (Change of user) requires his own Compliance Certificate (Insurance cover for the contents of the building). The original Compliance Certificate of the Landlord remains valid for the Landlord provided no changes to the originally certified installation has been made (Insurance Cover for the Building Structure). This is not just an insurance requirement but a legal one.
